These Terms of Service, together with our Privacy Policy and Refund Policy, govern your use of amealio, including our website, mobile apps, messaging channels and merchant tools offered in the United States. By using amealio you agree to these Terms. If you do not agree, please do not use the service.
1. General provisions
- amealio is offered in the United States in compliance with applicable federal and state law, including Section 5 of the FTC Act, state consumer protection statutes, the CAN-SPAM Act, the TCPA and the Americans with Disabilities Act.
- We may update these Terms. Material changes will be posted in the app or emailed to you at least 30 days before they take effect.
- Nothing in these Terms waives any non waivable right you have as a consumer under federal or state law.
2. Your account and acceptable use
- You must provide accurate information and keep your credentials confidential.
- You must not use amealio for any unlawful, fraudulent, harmful or infringing purpose, or attempt to access systems without authorization.
- We may suspend or terminate accounts that violate these Terms or applicable law.
- We honor Digital Millennium Copyright Act notices. Send takedown requests to legal@amealio.com.
3. Terms by feature group
The clauses below apply to specific feature groups in addition to the general provisions above. Where a feature specific clause conflicts with a general clause, the feature specific clause controls for that feature.
User Onboarding and Authentication
- You must be at least 18 years old, or the age of majority in your state, to create an account.
- You are responsible for the accuracy of your registration details and for keeping your login credentials confidential.
- By providing a mobile number you consent to receive account, security and service text messages. Message and data rates may apply. Reply STOP to opt out of marketing texts and HELP for help, consistent with the TCPA and CTIA guidelines.
AI Personalization Engine
- AI recommendations are generated automatically from your profile, preferences and activity. They are suggestions only and are not medical, dietary, nutritional or health advice.
- Guests with food allergies must confirm ingredients, preparation and cross contact directly with the restaurant before ordering. Allergen information is supplied by the restaurant, consistent with FDA menu labeling requirements.
Restaurant Discovery and Smart Search
- Restaurant listings, ratings, hours and availability are supplied by partner restaurants and third party sources and can change without notice.
- amealio does not warrant the accuracy of third party information such as menus, hours or promotions.
Celebration Platform
- Celebration bookings are subject to venue availability, vendor confirmation and applicable local ordinances and permits.
- Add ons such as cakes, decor, live performers and photography are provided by independent third party vendors. amealio acts as a facilitator and is not liable for the acts or omissions of those vendors beyond what is agreed in writing.
- Ready Package celebrations may be canceled up to 24 hours before the reservation for a full refund. Smart Choice and Custom Experience bookings follow the timelines confirmed at checkout.
- Alcohol, where offered by the venue, is served only to guests 21 and over with valid ID and at the venue's discretion under state liquor law.
Memory Wall and Smart Mirror
- By uploading, capturing or sharing photos or videos through Memory Wall, Smart Mirror or social sharing, you grant amealio a non exclusive, worldwide, royalty free license to store, process and display that content in order to provide the service.
- You confirm you have the right to share the content and have obtained consent from every identifiable individual, including any biometric or likeness consent required by state law such as the Illinois Biometric Information Privacy Act and the Texas CUBI Act.
- amealio does not use face recognition to identify guests. Photo features operate on capture and sharing only.
Reservations, Queue and Ordering
- Reservations are subject to real time availability. amealio may cancel or reassign a reservation if the venue becomes unavailable and will refund any prepaid amount in full.
- Prepaid reservations and deposits may be forfeited for a no show, as disclosed in the venue policy shown at booking.
- Accessible seating requests are supported and honored subject to venue availability in line with the Americans with Disabilities Act.
Delivery and Catering
- Where delivery is fulfilled by third party logistics partners such as DoorDash Drive or Uber Direct, the courier partner's terms also apply to that delivery.
- Alcohol delivery, where available, requires an adult signature and valid government issued ID at handoff under applicable state law.
Merchant Dashboard and AI Assistant
- Merchants agree to supply accurate menu, pricing, allergen and inventory information and to fulfill accepted orders on the confirmed terms.
- Commercial terms including commissions, subscription fees and payout timing are governed by the Merchant Agreement signed at onboarding.
- Merchants must hold all required state and local permits and comply with the FDA Food Code, local health department rules and applicable wage, tip and labor laws.
Marketing, Loyalty and Rewards
- Promotional codes and offers are subject to the specific terms shown with the offer, including expiration, minimum order value and eligible items. Void where prohibited.
Payments
- Card payments are processed by a PCI DSS Level 1 certified payment processor. amealio does not store full card numbers on its own servers.
- Approved refunds are initiated immediately and typically post to the original payment method within 5 to 10 business days, depending on your bank or card issuer.
- Partial refunds are issued when part of an order or service could not be delivered, calculated proportionally against the affected items or services.
- Applicable state and local sales tax is calculated at checkout and itemized on your receipt. Digital receipts are available in the app.
- Chargebacks and disputes are handled under the Fair Credit Billing Act, Regulation E where applicable, and the rules of the relevant card network.
- Any subscription or membership renews automatically until canceled and can be canceled at any time in Settings, consistent with the FTC Negative Option Rule and state automatic renewal laws.
Messaging Commerce
- Order and service updates may be sent by SMS, email and push notification. You can opt out of marketing messages at any time in Settings or by replying STOP.
- You must not misuse our messaging channels, including for spam, harassment or unlawful content. Marketing email complies with the CAN-SPAM Act and includes a one click unsubscribe.
Reviews and Social
- Reviews must reflect a genuine, firsthand experience. amealio does not pay for reviews and does not suppress negative reviews, consistent with the FTC Rule on Consumer Reviews and Testimonials.
- We may moderate or remove content that violates our Community Guidelines or applicable law. You remain solely responsible for what you post.
Marketplace and Channels
- Open network marketplace features are offered only where available. In the United States, orders are fulfilled directly by partner restaurants and their delivery partners.
- Issues with fulfillment are addressed jointly by the restaurant, the delivery partner and amealio support.
POS Integrations
- Where a merchant connects a point of sale such as Toast, Square or Clover, menu, price, inventory and order data flow between the systems. amealio processes that data only to provide the service.
Admin and Super Admin
- Administrative access to amealio systems is granted on a least privilege basis and every action is logged. Misuse may lead to termination and legal action under the Computer Fraud and Abuse Act.
Integrations
- Third party integrations are governed by the applicable third party terms. amealio is not responsible for downtime or errors caused by third party systems.
Future AI Experiences
- Preview and beta AI features are provided as is, without warranty. amealio may change or withdraw them at any time.
4. Cancellations, refunds and rescheduling
- Delivery and pickup orders may be canceled at no cost until the restaurant accepts. After acceptance a partial charge based on preparation status may apply.
- Ready Package celebrations may be canceled up to 24 hours before the reservation for a full refund.
- Smart Choice and Custom Experience bookings follow the timelines confirmed at checkout.
- Approved refunds typically post to the original payment method within 5 to 10 business days, depending on your bank or card issuer.
- Partial refunds are issued proportionally for the specific items or services that could not be delivered.
- Most bookings may be rescheduled once at no charge, subject to venue availability.
5. Consumer support and complaints
Our US support team is available 9 am to 9 pm PT, seven days a week, with 24/7 in app support for live orders. If something goes wrong we aim to make it right on first contact.

6. Accessibility
We design amealio to meet WCAG 2.2 AA. If you encounter a barrier, email accessibility@amealio.com and we will provide the information or transaction through an alternative accessible method.
7. Intellectual property
The amealio brand, software, video menus, AI models, designs and content are owned by amealio or its licensors. You may not copy, modify, distribute or create derivative works without prior written permission.
8. Disclaimers and limitation of liability
The service is provided on an as is and as available basis. To the maximum extent permitted by law, amealio disclaims implied warranties of merchantability, fitness for a particular purpose and non infringement, and is not liable for indirect, incidental, special, consequential or punitive damages. Our aggregate liability for any claim will not exceed the greater of the amount you paid for the transaction giving rise to the claim or one hundred dollars. Some states do not allow certain exclusions, so parts of this section may not apply to you.
9. Dispute resolution and arbitration
Most concerns are resolved by contacting support first. If a dispute is not resolved within 60 days, it will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, governed by the Federal Arbitration Act. Arbitration is on an individual basis only, and class actions and class arbitrations are not permitted. Either party may bring a qualifying claim in small claims court instead.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@amealio.com with your name and account email. Opting out does not affect any other part of these Terms.
10. Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules, except that your state's consumer protection laws continue to apply where they give you greater rights. Subject to the arbitration section, the state and federal courts located in Delaware have exclusive jurisdiction.
